Terms and Conditions

1. Acceptance of Terms

Thank you for choosing Analog Archive. These Terms & Conditions apply to all our services, together with any quotes and/or production estimates provided to you.
 

By using our website, engaging our services, or making a booking, you agree to be bound by these Terms.

If you do not agree, please do not use our services.

2. About Analog Archive

Analog Archive is a NSW based creative studio offering brand design and content creation services for local businesses to help their brands grow and thrive.

 

  • Our services may include, but are not limited to:

  • Brand identity design

  • Graphic design for print and digital

  • Social media and content creation

  • Photography and short-form videography

  • Creative consulting

  • Custom-tailored packages and add-on services

3. Client Obligations

You agree to:

 

  • Provide all necessary documentation, information, and assistance required to carry out the services

  • Ensure all information is complete, accurate, up-to-date, and compliant with applicable laws and industry regulations

  • Provide feedback within 5 business days (or as otherwise agreed in writing) when requested to proceed with work

  • Respond to communication promptly to avoid delays

 

Delays in providing required materials or feedback may impact delivery timelines, and Analog Archive will not be liable for any such delays.

 

4. Fees and Payment Terms
 

A 50% non-refundable deposit is required to secure your booking and commence work. The balance is due upon completion and before the release of final deliverables. Rush projects may incur an additional rush fee, quoted before commencement. Payment can be made by bank transfer (details will be on your invoice).

Third-party costs:

Quotes and estimates may exclude third-party costs such as printing, stock photography, or specialist services. These costs will be communicated and itemised in your final invoice where applicable.

 

Refusal or cancellation of payment:

Analog Archive reserves the right to refuse or cancel transactions suspected to be fraudulent, unauthorised, or illegal.

5. Refunds

To the maximum extent permitted under the Australian Consumer Law (ACL), any fees paid under this agreement are non-refundable, except where required by law.

 

Under the ACL, you may be entitled to a refund or replacement if there is a major failure with the services provided.

 

Creative work is subjective, and refunds are not provided for a change of mind once work has commenced.

 

Deposits remain non-refundable once work has started, regardless of cancellation by the client.

6. Disclaimers

  • Analog Archive will not be liable for any loss or damage resulting from inaccurate, incomplete, or outdated information or materials provided by the client

  • We are not liable for errors, issues, or interruptions beyond our control, including delays caused by third parties

  • We are not liable for faults, failures, or delays caused by a Force Majeure Event (events beyond our reasonable control)

  • Final responsibility for reviewing and approving work before publication or distribution rests with the client
     

7. Intellectual Property Rights

Definitions
 

  • Material – Tangible and intangible information, content, documents, and other materials in any media

  • New Material – Material created, written, developed, and brought into existence by Analog Archive

  • Existing Material – Material other than New Material

 

Ownership of Materials:

 

All New Material, including products, creative works, brand designs, and content created by Analog Archive, becomes your property upon full payment

 

Existing Material with reserved intellectual property rights remains the property of Analog Archive

Portfolio Rights

We reserve the right to showcase completed projects in our portfolio, website, and social media for the sole purpose of promoting our work, unless otherwise agreed in writing.

8. Privacy

Both parties agree to comply with:

 

  • The Privacy Act 1988 (Cth) and the Australian Privacy Principles

  • Analog Archive’s Privacy Policy (available on request or via our website)

  • We will notify you of any updates to our Privacy Policy.

 

9. Dispute Resolution

If a dispute cannot be resolved through normal communication, both parties agree to:

 

  • Attempt to resolve the matter in good faith through direct negotiation

  • If unresolved, participate in mediation via the Australian Disputes Centre (ADC), with costs shared equally between both parties

 

10. Termination

Either party may terminate this agreement by providing written notice to the other party.

 

On termination:

 

  • You will be invoiced for all services performed up to the termination date, including incomplete but prepared deliverables

  • Payment must be made within 7 days of the invoice date, unless agreed otherwise

  • Deposits remain non-refundable once work has commenced

 

Analog Archive will not be liable for any claims or damages arising from termination.

 

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of New South Wales.

12. Updates to Terms & Conditions

We may update these Terms from time to time. The latest version will be available on our website, and significant changes will be communicated by email or on our website before taking effect.
